Who is Eligible for Legal Aid?

Though legal aid is available in family law, rules and guidelines on eligibility mean it is only available to certain people and under certain conditions.

In family law, legal aid can cover issues such as divorce, child arrangements, domestic abuse cases, and care proceedings. However, it is only available for specific cases, primarily where there is evidence of domestic abuse, child protection concerns, or urgent legal matters that impact the welfare of a child.

Eligibility for legal aid depends on both the nature of the case and the applicant’s financial situation. The Legal Aid Agency assesses whether a person meets the criteria based on their income, savings, and the merits of their case.

 

Legal Aid for Care Proceedings

Typically, legal aid is subject to a means and merit test, which means that applicants are assessed based on their financial situation as well as the prospect of being successful (for example, there must be at least a 50% chance of your case being successful).

However, the eligibility rules differ when it comes to care proceedings. Any parent or person with parental responsibility who has care proceedings instigated on their child/children is automatically entitled to legal aid funding regardless of their income or their chances of success. This is to ensure that parents and guardians of the children in question have access to fair representation.

All other parties that are a part of the proceedings, such as grandparents or stepparents, are not automatically entitled to legal aid and will be judged on the basis of means and merits if they apply for funding.
